Introduction. Welcome to the website for the Atlantic Canada Small Business Expatriate Campaign (the "program"). This website is operated and maintained by the Atlantic Association of Community Business Development Corporations ("Association"). The Association is a not-for-profit association incorporated under the Canada Corporations Act.

The website provides a collection of online resources including an online succession planning database, classified ads, and various informational services (collectively, the "Service") relating to the program. The Service is provided on the terms of use set out here ("Terms"). By accessing the website, you agree to comply with these Terms. The Terms may be updated by the Association at any time. You understand and agree that you are solely responsible for reviewing these Terms from time to time. The Terms are designed to make sure that the website and the program work for everyone.

Content. You acknowledge that all listings, information, files, and other material (collectively, the "Content") posted on, transmitted through, or linked from the website or through the Service, are the sole responsibility of the person who originated such Content. More specifically, you are entirely responsible for all Content that you upload, email or otherwise make available via the Service. The association does not control, and is not responsible for Content made available through the website, and that by using the website, you may be exposed to Content that is inaccurate, misleading, or otherwise objectionable. Furthermore, the Association site and Content available through the website may contain links to other websites, which are completely unrelated to the Association. The Association makes no representation or guarantee as to the accuracy or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will the Association be liable in any way for Content or for any loss or damage of any kind incurred as a result of the use of any Content listed, emailed or otherwise made available via the Service. You acknowledge that the Association does not pre-screen or approve Content, but that the Association will have the right (but not the obligation) in its sole discretion to refuse, delete or move any Content that is available via the Service, for violating the spirit of the site or the Terms or for any other reason.

Posting Content. When you post information to the website, you grant the Association a non-exclusive, worldwide, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display the information you post.) If you believe that your rights have been violated, please contact us and we will investigate the matter. You agree that although, we do not pre-screen or approve content, we reserve the right to delete, move, or edit any postings or information that we consider unacceptable or inappropriate, whether for legal or other reasons. We prohibit the promotion of any item that is illegal under any applicable law, statute, ordinance, or regulation. It is your responsibility to ensure that the information that you post conforms to all applicable legal requirements.

Liability. You acknowledge that the website, the Services and the program are provided by the Association for information purposes only, and that we are unable to guarantee the accuracy of the information posted on the website. You also acknowledge that we cannot guarantee continuous or secure access to the website. YOU AGREE THAT, TO THE EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING THOSE ARISING BY STATUTE. WE ARE NOT LIABLE FOR ANY LOSS, WHETHER OF MONEY (INCLUDING PROFIT), GOODWILL, OR REPUTATION, OR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE WEBSITE OR THE SERVICES OR YOUR PARTICIPATION IN THE PROGRAM.

Dealings with organizations and individuals. The Association shall not be liable for your interactions with any organizations and/or individuals found on the website or through the Service. These dealings are solely between you and such organizations and/or individuals, and you agree that the Association shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. In the event that you have a dispute arising out of or in connection with your use of the website or the Service, you release the Association, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and / or our service.

No Spam Policy. You understand and agree that sending any unsolicited email advertisements to email addresses at our website domain names, our user addresses, or through our computer systems is prohibited.

Limitations and Termination. You agree that we may establish any limits in regards to the use of the Services, the program and this website. You agree that we have no responsibility or liability for the deletion or failure to store any content maintained or transmitted through our website. You agree that we reserve the right to modify or discontinue our services or any part of our services, at any time with or without notice. You further agree that we have the right to delete or deactivate your postings, or otherwise terminate your access to or use of our websites and services without notice.

General. These Terms constitute the entire agreement between the Association and you, and are governed by the laws of Nova Scotia, without reference to conflict of laws provisions. If we elect not to enforce a particular provision, we are not waiving our right to do so later. If any of the Terms is found to be invalid, that decision shall not affect the validity of the remaining Terms.
